Conditions of
Use
This website is owned and operated by Hearts and Desires. Please
make sure that you read through these terms and conditions carefully
before using this website as your use of the website will signify
your agreement to be bound by them.
The terms and conditions apply
to all purchases of products by you from Hearts and Desires. These
will be updated from time to time so please make sure you read them
before making a new purchase.
1. Access to Hearts and Desires
We will do our utmost to ensure that availability of the website
will be uninterrupted and that transmissions will be error-free.
However, due to the nature of the Internet, this cannot be
guaranteed.
Also, your access to the website may also be
occasionally suspended or restricted to allow for repairs,
maintenance, or the introduction of new facilities or services.
We
will attempt to limit the frequency and duration of any such
suspension or restriction.
2. Ordering
When you place an order to purchase a product from Hearts and
Desires, we will send you an e-mail confirming receipt of your order
and containing the details of your order. Your order represents
an
offer to us to purchase a product, which is accepted by us when we
send e-mail confirmation to you that we have despatched that product
to you.
That acceptance will be complete at the time we send the
confirmation email to you. We do not file details of your order for
you to subsequently access direct on this website, and you are
therefore advised to print out these terms and conditions together
with the order acknowledgement for your own records.
3. Pricing
All prices are quoted in Pounds Sterling and include VAT at the
standard rate.
All prices are exclusive of postage. You will be given the total
price of your transaction before you complete your purchase.
4. Payment
We take payment from your card at the time we confirm your order,
once we have checked your
card details and stock availability. Goods
are all hand made and are subject to availability.
In the unlikely
event that we are unable to supply the goods, we will inform you of
this as soon as possible. A full refund will be given where you have
already paid for the goods.
The price you pay is the price displayed on this website at the time
we receive your order.
However, whilst we make every effort to try
and ensure that all prices on our website are accurate,
errors
sometimes occur. If we discover an error in the price of goods you
have ordered we will inform you of this fact as soon as possible.
You will be given the option of reconfirming your order at the
correct price or cancelling it. If we are unable to contact you we
will treat the order as cancelled.
If you cancel and you have
already paid for the goods, you will receive a full refund.
Title to any products you order on this website shall pass to you on
delivery of the products provided that we have processed and
received payment in full for the products.
We accept payments by most major credit cards, cheque and Paypal.
Payment must be in
Pounds Sterling. Hearts and Desires does not
hold, nor have access to, customers credit card details.
5. Delivery
Orders will be despatched by Royal Mail Standard First Class
Delivery unless otherwise discussed. Delivery times are in line with Royal Mail schedules and
are generally within 7 working days.
If a product is in stock we aim
to send it to the specified delivery address within 1 day of your
order.
If we cannot despatch an item to you within the specified
time we will notify you by email and if desired we will cancel the
order and refund your money in full.
Once the gift has been delivered to the delivery address it is no
longer the responsibility of
Hearts and Desires. Refunds cannot be
given if the gift is not passed on to the main recipient.
All delivery times are approximate. Our liability for non-delivery
is limited to replacing the product within reasonable time. Hearts
and Desires cannot be held responsible for delays in delivery caused
by
external influences i.e. Royal Mails' own delay.

Once the gift has been signed for at the delivery address it is no
longer the responsibility of
Hearts and Desires. Refunds cannot be
given if it is not passed on to the main recipient.
6. Acceptance
The customer shall inspect the goods within 7 days of their receipt
for flaws or damage.
Since each piece is individually made by hand,
some variations may occur in finishes. These variations add to the
uniqueness of the piece and are not to be considered "flaws". This
does not affect the customers statutory rights.
7. Guarantee, Refunds and Returned Goods
If any products supplied by us are found to be defective or
different from those ordered,
Hearts and Desires will provide a full
refund on prompt return of the products.
Goods that are exchanged or
replaced for reasons other than complaint will be subject to the
cost of the postage and packaging. We will not accept responsibility
for postal charges or lost items when returning non-defective goods.
If you return your order for any other reason within 30 days a full
refund will be given, less the cost of postage and packaging.
All returned goods must be in their original supplied condition and
in the original packaging. For your own benefit, we suggest using
Royal Mail Special Delivery. This will ensure that there is proof of
delivery and insurance on the goods whilst in transit. We cannot
issue refunds on goods that fail to reach us.
This does not in any way affect your statutory rights. Any enquires

If we have tried to deliver your gift but an incorrect delivery
address has been supplied, we will contact you by email and offer to
re-deliver subject to a further shipping charge.
If you decide to
cancel your order we will refund your payment less the cost of the
original delivery charge.

Hearts and Desires do not accept any responsibility for recipients
opening the gift box with a sharp object e.g. a knife or scissors,
which could damage the contents.
8. Safety
The products which are sold via this website comply with the health
and safety laws of the
United Kingdom. Some of our products contain
small items such as buttons, rosettes, ribbons and accessories.
To
avoid possible choking hazards, please keep away from children and
babies.
Our items are for decorative purposes only, therefore we cannot
accept responsibility if used for any other purpose.
9. Data Protection and Privacy
Hearts and Desires will not pass on any customer details to any
third party.
We are committed to protecting your privacy. We will
only use the information that we collect about you lawfully (in
accordance with the Data Protection Act 1998). We will not email you
in the future unless you have given us your consent or joined our
mailing list.
10. Legitimate Web Site Use
You must not use the website in any way that causes, or is likely to
cause, the website or access to it to be interrupted, damaged or
impaired in any way. You understand that you, and not Hearts and
Desires, are responsible for all electronic communications and
content sent from your computer to us and you must use the website
for lawful purposes only.
You must not use the website for any of the following:
* for fraudulent purposes, or in connection with a criminal offence
or other unlawful activity.
* to send, use or re-use any material that is illegal, offensive,
abusive, indecent, defamatory, obscene or menacing; or in breach of
copyright, trademark, confidence, privacy or any other right; or is
otherwise injurious to third parties; or objectionable; or which
consists of, or contains, software viruses, political campaigning,
commercial solicitation, chain letters, mass mailings or any "spam".
* to cause annoyance, inconvenience or needless anxiety.
11. Enquiries, Comments, Communications and
Other Content
Users of this website may send enquiries, comments, communications
and other information, as long as the content is not illegal,
obscene, abusive, threatening, defamatory, commercial solicitation,
chain letters, mass mailings, or any form of "spam."
12. Copyright
All content included on the website, such as text, graphics, logos,
button icons, images is the
property of Hearts and Desires.
You may not systematically extract and/or re-utilise parts of the
contents of the website without
Hearts and Desires express written
consent.
13. Products
The products selling on Hearts and Desires are all genuine and are
owned by Hearts and Desires.
Sometimes the product specifications from the manufacturer may
change, in which case we will do our best to offer you a substitute
of the same or better quality at the same price. You will be
informed on the replacement of your order before it is despatched.
If you are not satisfied with your replacement, you will be able to
cancel your order and/or get the refund on it/them if you have
already paid for the item(s).
14. Security
Ordering at Hearts and Desires could not be safer or easier. Paypal
is our preferred, secure, method of payment for all transactions.
Paypal ensures the security and integrity of all sensitive data. The
transfer of purchase details from our site to Paypal are
encapsulated using encrypted and digitally-signed protocol.
This ensures that the information passed is secure and tamper-proof
. Any communication between the customer and Paypal is encrypted to
the maximum strength supported by the shoppers browser.
15. Cancellations
If you have NOT yet received your confirmation of despatch email
notifying you that your order has been despatched then you may
cancel your order by emailing

Please include
your Order Ref number and full details of your order.
Please note that you CANNOT cancel your order once it has been
despatched, if you wish to cancel an order that has already been
despatched you will need to return the item(s) to us for a refund in
accordance with our Returns policy.
16. Alteration of Service or Amendments to
the Conditions
We reserve the right to make changes to our website, policies, and
these Conditions of Use & Sale at any time. You will be subject to
the policies and Conditions of Conditions of Use & Sale in force at
the time that you use the website or that you order goods from us,
unless any change to those policies or these conditions is required
to be made by law or government authority (in which case it will
apply to orders previously placed by you). If any of these
conditions is deemed invalid, void, or for any reason unenforceable,
that condition will be deemed severable and will not affect the
validity and enforceability of any remaining condition.
17. Events Beyond Our Reasonable Control
We will not be held responsible for any delay or failure to comply
with our obligations under these conditions if the delay or failure
arises from any cause which is beyond our reasonable control. This
condition does not affect your statutory rights.
